Should I officially start a credit repair organization?

Doctor Config asked:

I have been assisting several individuals with improving their credit. I know most companies are rip offs. However, unlike someone who takes your money and runs off doing nothing. I sit down and map out how to approach removing the credit issues. What I explain is anyone of course can provide these services. I am familiar with the FCRA, FDCPA, Statue Of Limitation Laws, etc. Last year in helping people I help 20 people acheive their goals. I feel I have something legitmite to offer people. I guess my question is I’ve checked with my state (MD) and I found there were no applicable licence for my business type. I only would have to be licenced and bonded if I act as one of these debt consolidation which I choose not to be. However, in networking I spoke to someone who advised my state is leary of that term….Does anyone know for sure if this is legal?

How to Improve your Credit Rating

Adam Singleton asked:

Every financial move you make can come back to haunt you if you don’t handle your finances in a responsible way. From paying your utility bills to keeping up with your mortgage, the way you handle money can be a big factor in how your overall credit rating is decided.

The first step to making sure your credit rating is up to scratch is to get hold of a copy of your credit file. This will enable you to ensure all the details are correct. No company is perfect, and some people have found there are errors on their credit report that would hamper them if they decided, for example, to apply for a loan. If you find an error, it’s important that you get it corrected so that it doesn’t affect your future good standing.

Missing payments can be held against you as well, even if the reason for missing them was a genuine one and not because of any financial difficulty. The best remedy for this potential problem is to set up a standing order or direct debit for each payment. This will mean you don’t need to remember to pay bills each month, as they will be done automatically once you have set them up.

A big reason for not being able to obtain credit is if your credit record shows you already have access to too much. However, sometimes the opposite can apply. If you want to get a mortgage, for example, and you have no credit history at all, you may find it difficult to get accepted for one in order to buy the house of your dreams.

If you are in this situation, credit cards can provide an ideal solution. All you need to do is apply for a credit card and pay it off in full every month. If you do this you will show that you are good with money and a safe bet for handling the responsibility of a mortgage.

If you run into difficulties with making any payments, the best thing to do to protect your credit rating is to discuss the situation with the companies you owe money to. It’s far better to contact them as soon as you run into difficulties, rather than waiting for them to contact you. So long as you can pay a small amount on a regular basis, you will still be taking control of your finances and dealing with them in a responsible way.

It’s also worth remembering that every payment and every line of credit you have counts towards your overall score. What matters is how prompt you are with your payments, rather than just the amount they are for. If you can show that you are good with money and you pay all your bills on time, you shouldn’t have any problems with your own credit rating.

How to Repair Your Credit Without a Credit Repair Clinic

Joseph Feross asked:

This generation has turned into a microwave society. People want things done quickly, and repairing your credit is no exception. People get hyped up by guaranteed claims of repairing credit fast and easy. The truth is that is not the case. There are places called credit repair clinics that claim to be able to remove all negative information from your credit report. They also claim that your can credit can be wiped clean. Of course, there is a catch. You will have to pay a fee and it’s usually in the hundreds of dollars for their “services”.

Credit repair clinics are nothing more than a sham. You shouldn’t fall for them because they have no legal right to delete, repair or adjust your credit report. The only entity that can legally adjust or delete information is the credit bureau. Negative items, depending on what they are, can stay on your report for either seven (general negative information) or ten years (bankruptcy, i.e. Chapter 7). These so-called clinics have no legal right to remove these items from your credit report. If they tell you otherwise, they’re lying in order to get your money. In fact, they really don’t do anything to help you improve your credit.

However, there is a way to do credit repair without you having to be scammed by these companies. You can repair your own credit. It’s good for you to do that so you’ll know what’s on your report and what each item posting is about. You will also learn different legal and cost-effective strategies that can be used to repair your credit. If you have quite a bit of debt, it may take some time to clean it up, unless you have a large lump sum to wipe it out.

Since you’ll be doing your own credit repair, Get a copy of your credit report and look at it thoroughly. If you find errors in it, make note of them. You will have to contact the credit bureaus and dispute the claims. By law, the bureaus must at least conduct and investigation to find out whether adjustments need to be made to your credit report. If they do find errors, they must be corrected. Or if they can’t verify the information, it must be deleted. If you wish, you can also send them a brief correspondence disputing the errors in your credit report.

Just think-if you were to allow a credit repair clinic to do this for you, do you know how your credit would end up? In addition to charging you hundreds of dollars to do what you can do yourself, they won’t tell you what you need to know about getting your credit straight. They’ll just take your money and run.

Credit repair clinics could care less about helping your to get your credit together. They’re just looking out for themselves to see how much they can get out of the deal. Some of them will actually use some of the same strategies that you would use to repair your credit.

This may sound like a lot to do, but it’s a far better credit repair strategy that paying hundreds of dollars to a company that claims they can erase your negative credit. When it’s all said and done, you will be glad that you chose to do it yourself.

Bad Credit Rating – a Good Thing?

Steve Gillman asked:

A bad credit rating is usually considered a problem, but is it always so? Are there circumstances where it can be beneficial?

Credit is a tool that has to be handled with wisdom to be of value. Being able to borrow money or get credit cards doesn’t automatically make a person able to handle that power. In fact, it has gotten many people into serious financial trouble. Wouldn’t it have been better for many of them if they had not been able to obtain credit?

Bad Credit Rating – Two True Stories

A friend, whom I will call Jill, didn’t pay a phone bill early in adulthood, and made a few other minor mistakes that hurt her credit rating. While it was true that this made it difficult to get a home mortgage later in life, it is also true that it made it almost impossible for her to get credit cards. This was a a good thing, as even she will admit. She just wasn’t ready to handle that kind of responsibility, and so her poor credit rating has prevented her from getting deep into debt.

As a result, Jill has to pay cash for things, or wait until she saves enough money. Does this make her a less happy person? Not as far as I can tell. While it’s true that she wants to borrow and get credit cards, her inability to do so also means she doesn’t have the debt-stress that is so typical now.

Another friend, whom I will call Mark, started his adulthood with a good credit rating. He could get credit cards at will, and finance cars and snowmobiles too. He did all of it. With a decent job he was able to make the payments on his debts – at least at first. But by the time he was 30 years old, he had over $22,000 in credit card and other consumer debt.

Eventually it was too much to handle, and he only avoided bankruptcy by convincing the credit card companies to reduce his balances due. To do this he had to stop paying on the cards, or the companies wouldn’t believe his letter explaining his dilemma. Most cut at least 30% off what he owed, provided he paid the remaining balance right away, which he did with a home equity loan.

As a result of this maneuver, his credit rating wasn’t as bad as if he had actually declared bankruptcy, and he was able to rebuild his credit score – as well as his credit balances. He quickly began again the stressful process of overburdening himself with debts. So was Mark’s decent credit rating a good thing? He has some nice “toys”, but as his friend I also see the added stress and unhappiness.

Credit Lessons And Opportunities

A bad credit rating certainly is not something to aim for. On the other hand, if you already have one, why not see it as a lesson and an opportunity? The lesson? Your habits got you there and they would probably get you into more trouble if you could borrow even more money. The opportunity? Learn these lessons and develop better habits.

Pay cash. Get in the habit of saving for things. Knock down those credit card balances. Start setting aside money for a good used car that can be bought without a loan. Then start to put aside what would have been a car payment for a future down payment on house or even a business. Your bad credit rating can be a good thing, if you learn your lesson and seize the opportunity to become a better manager of your personal finances.
